Appendix A – California Consumer Privacy Act (“CPPA”) Rights

Additional provisions applicable to processing personal information of California residents.

I. Scope and Applicability

This Appendix A (“Appendix”) applies to California residents and outlines your rights and choices regarding the processing of personal information we have about you under the California Consumer Privacy Act (“CCPA”). This Appendix controls to the extent it conflicts with any provision in the main body of the Notice. Capitalized terms used in this Appendix are defined in our Notice.

A. Terminal as a Service Provider

Terminal acts as a service provider for personal information collected on behalf of our customers, who are the businesses responsible for determining the purposes and means of processing personal information while using our Services.

B. Terminal as a Business

Terminal acts as the business responsible for determining the purposes and means of processing personal information while using Terminal Services in the following ways:

  • On our Site.
  • For sales and marketing.
  • To assist our clients in hiring employees.
  • During our standard business practices.

II. Information We Collect and How We Use Information

Please see the “Information We Collect” and “How We Use Information” sections in our Privacy Notice to learn more about the personal information we collect and use.

We collect the following categories of information as classified under the CCPA:

  • Identifiers, such as your first and last name, email address, and IP address.
  • Personal information categories (Cal. Civ. Code § 1798.80(e)), such as your name and phone number.
  • Internet or other similar network activity information, such as information regarding your interaction with our Site.
  • Professional or employment-related information, such as your business contact information, job title, and company name.

Personal information does not include publicly available information. For purposes of this paragraph, “publicly available” means information that is lawfully made available from federal, state, or local government records. “Publicly available” does not mean biometric information collected by a business about a consumer without the consumer’s knowledge.

III. How We Share Information

Terminal shares your personal information with service providers such as technology service providers, business partners, and consultants, as part of our business practices and to provide you with our Services. Terminal does not sell your personal information to advertisers or other third parties.

Terminal share the following categories of information as classified under the CCPA:

  • Identifiers, such as your first and last name, email address, and IP address.
  • Personal information categories (Cal. Civ. Code § 1798.80(e)), such as your first and last name, phone number, and employment history.
  • Internet or other similar network activity information, such as information regarding your interaction with our Site.
  • Professional or employment-related information, such as your employer, job title, and compensation expectations.

Please see the “How We Share Information” section in our Notice for additional details on how we disclose your personal information with selected recipients for specific purposes.

IV. Your Choices

A. Where the CCPA Applies to Terminal as a Service Provider

Our Services are intended for use by other companies (our customers). Our customers are responsible for determining the purposes and means of processing personal information. Individuals seeking to access or delete personal information collected by our customers should contact our customers, who have transferred data to us for processing. The customer is responsible for responding to consumer requests according to applicable local data protection laws. Where applicable and required, Terminal will assist our customers with deletion requests upon verified request.

B. Where the CCPA Applies to Terminal as a Business

You have certain rights related to the personal information we hold about you when you use Terminal Services. Some of these rights only apply in certain circumstances, as set out below.

C. Your Rights

The CCPA provides California consumers with the following rights:

  • Right to Access – You have the right to request access to the categories and specific pieces of personal information we have collected about you in the previous 12 months.
  • Right to Deletion – You have the right to request that we delete any personal information we have collected about you.
  • Right to Request Information – You have the right to request information about the collection and disclosure of your personal information from the previous 12 months.
  • Right to Opt-out of the Sale of Information – You have the right to opt-out of the sale of personal information we have collected about you. Terminal does not disclose or “sell” personal information to third parties as defined by the CCPA.
  • Right to Non-Discrimination – You have the right to not receive discriminatory treatment for exercising any of your CCPA rights. Terminal will not treat you differently for exercising any of the rights described above.

You can exercise the rights listed above by contacting us using the email address in the “Contact Us” section below. You may also authorize an individual to submit a verifiable consumer request relating to your personal information.

To help protect your privacy and maintain security, we take steps to verify your identity before responding to requests. To verify your identity to make the request and confirm the personal information relates to you, we may ask that you submit your request by logging into your Terminal account to confirm your identity.

If you wish to use an authorized agent to submit a request to opt-out on your behalf, you must provide the authorized agent written permission signed by you, the consumer. We may deny a request from an authorized agent if the agent cannot provide to Terminal your signed permission demonstrating that they have been authorized to act on your behalf.

Generally, we will respond within 45 days of receiving your request. Your request and choices may be limited in certain cases, for example, if fulfilling your request is not permitted by law or if we have compelling legitimate interests to keep your information.
